Pesticides are any substance or mixture of substances that prevent, destroy, repel or mitigate a pest, or any substance or mixture of substances intended for use as a plant regulator, defoliant, or desiccant. The average person encounters these substances on a daily basis given this broad definition and the variety of substances that can qualify as a pesticide. Herbicides, insecticides, termiticides, and algaecides are just a few of the substances that fall under the definition of a pesticide. Federal and South Carolina law requires that pesticide applications be made according to label directions. However, what qualifies as a proper application varies from substance to substance.
Our firm understands and is experienced with the South Carolina and Federal laws relating to pesticides and the regulation of the structural pest control industry. These laws include the South Carolina Pesticide Control Act, the Federal Insecticide Fungicide Rodenticide Act and applicable regulations of the US Environmental Protection Agency (EPA) and the US Department of Agriculture (USDA).
Our attorneys are well prepared to represent parties to disputes concerning the proper application of pesticides as well as matters involving the inspection of both commercial and residential structures and the issuance of Wood Infestation Reports (a.k.a Form CL-100s).
